These Terms and Conditions and your use of our web site are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights.
This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.
Online Ordering Details
By placing and confirming your order on the French Sole website you have agreed to our terms and conditions as explained here. A Contract between the customer and French Sole Ltd for the sale of our products will only exist once an order has been accepted, processed and despatched ( at which point the buyers credit/debit card will be charged for the value of the goods despatched). This does not affect the customer's statutory rights. Customers who attempt to create orders for shipment to anywhere within the USA agree to have their order passed to ballerinas by JANE WINKWORTH, there will be no contract between a customer located in the USA and French Sole Ltd.
French Sole Ltd reserve the right to cancel any order at any time providing no payment has been taken.
Prices and availability of goods is subject to change without notice.

Your Right To Cancel
Under the Consumer Protection (distance selling) Regulations 2000, you have a statutory right (exercisable up to and including the seventh working day after the day of delivery), to cancel your order for any reason and receive a full refund.
If you have recently placed an order with us and wish to cancel it, please email us at info@frenchsole.com quoting your Order Reference No, Date order placed, Name. Providing the conditions of our returns policy are met entirely (as stated below) you will receive email confirmation of the cancellation of your order within 24 hours from receiving the goods back in perfect condition. Returns Policy
If you wish to return any items purchased online at www.frenchsole.com, please follow the following steps:
1. If you wish to return an item, you must notify your intention to return it, in writing, within 7 working days from the date you received your goods. The item(s) must then be returned within 14 days of invoice date.
2. All items must be returned in unused (re-saleable) condition.
3. The customer is responsible for the postage costs incurred when returning an item. Goods must be returned with proof of purchase by registered post only. We cannot be held responsible for any item returned to us in any other way.
4. If a customer returns an item that is not re-saleable (and therefore not entitled to a refund/exchange) the customer will be responsible for the shipping fees incurred to return the items. If in doubt take high resolution pictures (not bigger than 2 megabites) of the shoes (including the soles) and contact French Sole at info@frenchsole.com attaching the pictures and details of your return, our customer service team will then be able to assist you before you incur shipping costs on items that may not be in a re-saleable condition.

Return of Faulty, Incorrect or Sub-Standard Products
Please follow the same procedures as above. However, if the products you return are faulty, incorrect or damaged in transit, we will refund you the cost of the return postage, as well as the goods and your original postage and packing charge providing there is no evidence of the goods being damaged after delivery.

Return of Items in order to exchange
By returning shoes for an exchange you have agreed to have the credit card that was used for the original order debited/refunded by the difference of the original item and an additional shipping charge.

Payment and Taxes
We accept online payment in a secure environment by credit card. We currently accept Visa, Mastercard, Delta, Switch & Amex. All transactions are shown in £ sterling. To use French Sole gift vouchers please call 01189 888800.
All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.

Delivery
We attempt to dispatched your shoes the following day to receiving your order. However, we do maintain a 28 day delivery policy. Your shoes will be delivered using registered post or next day delivery by City Link (where available). When there is a delay to items sent outside the UK it is often due to your local mail service, please take this into consideration when waiting for delivery of your order. If, for some reason items in your order are out of stock, we will contact you immediately to organise a replacement or back order, no payment will have taken at this point and any part order will not be sent out for delivery unless requested. French Sole do not take any payment until the goods have been picked for your entire order. For UK customers we will attempt to use City Link for next day delivery on all main land postcodes, if City Link do not accept your postcode we will fall back to Royal Mail. City Link will deliver the NEXT WORKING day. Please read our City Link terms and conditions below.
If the customer supplies an incorrect delivery address and the order is returned to us, French Sole will not refund any delivery costs. The same applies to overseas orders, if your local postal service are unable to find your address to deliver your goods and the package is returned to us, French Sole will not refund any delivery costs associated with the order. It is the customers responsibility to enter their address correctly and to make sure the address is known to their local postal service, this is also true for City Link deliveries.

Delivery Charges
French Sole Limited reserve the right to adjust the delivery charges offered (pre purchase) as and when necessary.
This measure has become necessary due to increasing fuel tarrifs passed to us by our carriers.
VAT will be charged to shipping costs where applicable. All shipping costs listed on the website are shown without VAT and the VAT cost is calculated and shown
as a total combined for both goods and shipping.

City Link Deliveries
We will send you an email specifying your City Link delivery reference number as soon as the order is processed for delivery. It is the responsibility of the customer to give French Sole the correct delivery address at the time of ordering and to be available at the delivery address specified the next working day. If you are not available City Link will leave a card for you to organise a further delivery attempt, French Sole will also email you to confirm that a delivery was attempted. If you have any problems getting through to City Link with the number provided by them please call our mail order department on 01189 888800 or email us at info@frenchsole.com and we will re-arrange everything for you. City link will only hold your package for five days from the first delivery attempt before returning it to us so please make sure you re-arrange your re-delivery within this period.
We will attempt to resolve any delivery issues as quickly and effectively as possible. Should these issues be the result of an error made by French Sole or City Link we will of course accept responsibility and effect a delivery as quickly as possible with no penalties to the French Sole customer.
However, the customer will be responsible for the following situations:
In the event that you miss your delivery twice, we may be able to arange a 3rd delivery attempt with a further charge of £5.00.
If you have supplied us with incorrect address information or you wish your parcel to be delivered to a different address or depot you are agreeing to a further charge of £10.00.
If your parcel is returned to us after two delivery attempts and 5 days in the depot you will be refunded the cost of your order less £12.00.
If you wish a further delivery attempt by City Link instead of a refund then there will be a separate charge of £15.00.
ALL these charges are placed upon us by City Link, it is the responsibility of the customer to provide us with the correct delivery information at the time of ordering. No one will be exempt from these charges. If you wish to proceed with one of the above additional charges you must contact us directly in order for us to facilitate the request. City Link will not accept any of these requests directly. In the unlikely event that your request is directly accepted by City Link you are accepting responsibility for the penalty charges and therefore you are permitting French Sole the right to recover the penalty charges directly from the credit card used for your order. Should this fail you will be invoiced directly and all appropriate actions will be taken to recover these penalty charges. (NB Non mainland parts of the UK will be sent by Royal Mail and charged accordingly as City Link charge a premium delivery rate to these parts of the UK making it non cost effective.)

Communication
We will attempt to communicate with mail order customers by email. All relevant information about your order will be sent to the email address you have provided to us. If you have signed up to the French Sole Newsletter please make sure that you supply us with your correct country of origin. We make every effort to ensure that our Newsletter is not knowingly sent to any persons who reside in the USA, we reserve the right to remove any email address from our Newsletter if we suspect that they have entered an incorrect country of residence.

VAT
VAT is added to all orders with a delivery address inside the EU at the UK rate of 17.5%. If you are not an EU member state then you will have a zero rate of VAT applied to your order when you login and confirm your delivery address.
